Fed: Howard defends Andrews' handling of Haneef case

The prime minister says he believes Immigration Minister KEVIN ANDREWS was correct
.. when he decided to cancel Dr MOHAMED HANEEF's working visa.

Federal Court justice JEFFREY SPENDER has quashed Mr ANDREWS' decision to cancel the
27-year-old Indian doctor's work visa on character grounds.

Justice SPENDER says the minister made a jurisdictional error .. in cancelling Dr HANEEF's visa.

JOHN HOWARD says the government's appealing the court ruling .. because it believes
Mr ANDREWS' decision was valid.

The PM's told ABC TV .. because the case is still before the courts he's limited in
what he can say about it.

But Mr HOWARD says Justice SPENDER didn't find Mr ANDREWS acted in bad faith.







Dr HANEEF was charged with a terror-related offence last month .. but released when
the Director of Public Prosecutions withdrew its charge on July 27.

He left Australia voluntarily on July 28 .. but says he'd like to return.
