The individual mandate, requiring all US citizens to have health insurance, has been ruled "unconstitutional" by a Virginian judge, Henry Hudson, according to a BMJ news article. The ruling was made at the District Court in Richmond, Virginia. Judge Hudson said that the courts had never extended the "commerce clause" of the US constitution so far. The ruling will not impede the entire healthcare reform act as the requirement for all US citizens to have health insurance is not required until 2014. The US President's Press Secretary, Robert Gibbs, says they disagree with the ruling and that they are "confident that it is constitutional".
